Noise Ordinances
7-401 Disorderly Conduct
- A person is guilty of a violation of the ordinances of this City if, with intent to harass, annoy, or alarm another person or in reckless disregard of the fact that another is harassed, annoyed or alarmed by his behavior, he, within this City:
- In a public place, uses abusive, obscene, insulting, or offensive language, or an abusive, obscene, insulting, or offensive gesture, under circumstances in which such language by its very utterance, or gesture is likely to cause or provoke a disturbance or breach of the peace.
- Makes unreasonable noise.
7-413 Noisy Party Ordinance
- Noisy parties prohibited. No person shall participate in any party or other gathering of people giving rise to noise, disturbing the peace, quiet or repose of another person within the City of Wahpeton.
8-405 Loud, Disturbing and Unnecessary Noises Prohibited
The making, creating, or maintenance of loud, unnatural or unusual and disturbing noises are a detriment to public health, comfort, convenience, safety and welfare and hereby declared to be unlawful and a public nuisance. The following acts, among others, are declared to be prohibited noises in violation of this diction:
- The sound of horns or signaling devices on any motor vehicle, or motorcycle on any street or public place except as a danger warning or their sounding for an unnecessary and unreasonable period of time.
- Radios, phonographs, etc.
- Loud speakers and amplifiers.
- Yelling, shouting, etc particularly between the hours of 11 p.m. and 7 a.m. or at any time or palce so as to annoy or disturb the quiet, comfort, or repose of persons in any office, or in any dwelling, hotel or other residence, or of any persons in the vicinity.
